The following procedures are guidelines for how to be compliant with the "Can Spam Act of 2003". Thomson ISI, referred to below as Scientific Direct, and its employees are compliant with the "Can Spam Act". Scientific Direct maintains the highest standards and will exceed the requirements of the "Can Spam Act". We have incorporated the the new law with our current procedures for sending out email. Please read on for the requirements of the new law and the new Scientific Direct procedures.
Requirements for commercial e-mail, "Can Spam Act of 2003"
- Each message must have a "clear and conspicuous" notice of opportunity to decline to receive further commercial email messages from the sender.
- Each message will contain a functioning return e-mail address or link which will be clearly and conspicuously displayed. Recipients will be able to use this email address to request not to receive future advertisements or promotions. This return address must be capable of receiving such messages for at least 30 days after the transmission of the original message. Mailers may not send subsequent advertisements or promotions more than 10 business days after the request from any recipient to be removed from the future commercial e-mail communications. If the recipient has requested not to receive further advertisements or promotions, mailers may not request, sell, lease, exchange or otherwise transfer or release the e-mail address of the recipient.
- Mailers are also required to provide a valid physical postal address in any email communications. A post-office box (PO Box) or mail-drop does not suffice. The physical address must be somewhere that the consumer can physically find the sender or their employees.
- Mailers are required to maintain and provide a suppression file for each campaign.
Scientific Direct procedures for commercial e-mail:
- Material of "questionable" content will be reviewed by and approved by Scientific Direct before it is submitted for testing.
- Each message will contain a header and footer. The header, provided by Scientific Direct will clearly and conspicuously represent the mailer of the message and the intent of the message. The footer, to be provided by the customer, must contain a valid mechanism for removal from the list, which needs to be tested prior to the delivery of each campaign. Additionally, each footer will contain a valid physical postal address,also to be provided by the customer.
- Two opt-out messages must now be included in each campaign, one to be provided by the customer and the other by Scientific Direct. Each opt-out message must contain a functioning opt-out link or email address to the corresponding site. In other words, the customer's opt out message will contain a link to the customer's site and Scientific Direct's opt-out message will contain a link to the Scientific Direct site. Scientific Direct customers will bear the responsibility for collection of opt-outs from mailings they initiate. Similarly, Scientific Direct's internal opt-out link will automatically remove someone from that list and will be operational for a minimum of 30 days after the campaign is completed.
- Each campaign request must be accompanied by the customer's e-mail suppression list. This suppression file will be used to remove any records that would be sent during the customer's campaign. This file will not be used for any other purpose.
- Each from address must be the name of a valid mailer or company, no vanity from alias's will be sent (i.e. - Special Offers, Great Deals, etc.)
- Each message will contain a valid return address for manual removes. This address will be tested prior to delivery of each campaign. Manual removes from a return box are to be taken off the files within 10 business days of the mailing.
- Every list order will be run within 24 hours of the scheduled delivery of each list to ensure that the current permission status is selected for each record.
- Each campaign will be tested through the spam filters of Scientific Direct's service bureau to determine if the message is being caught by spam filters. The customer will be notified to make the appropriate changes to the copy before it can be sent out.
- All campaigns must be approved by the customer prior to sending.
